Who Must Wear a Helmet in Florida?Under Florida law, motorcyclists must wear helmets unless they are 21 years of age and have $10,000 or more in medical insurance coverage on their vehicle insurance policy. According to Section 1. Subsection (3) of section 316.211, Florida Statutes, all passengers under the age of 16 must wear a helmet at all times. These laws apply to both anyone who is a Florida resident and to anyone who is visiting Homestead or the state and riding their bike.
